RIGHT OF WITHDRAWAL & RETURNS POLICY

At Labuta Laureada, we want you to be happy with your purchase. If you change your mind about an online purchase, European consumer law generally provides a 14-day right of withdrawal, subject to certain legal exceptions.

This policy explains how that right works for purchases made through our online shop.

1. YOUR 14-DAY RIGHT OF WITHDRAWAL

If you are a consumer purchasing products online, you generally have the right to withdraw from your purchase within 14 days without giving a reason.

The withdrawal period normally begins on the day you, or a person you have nominated other than the carrier, receives the goods.

If your order is delivered in several separate parcels, the withdrawal period may begin when you receive the last item or parcel, as provided by applicable law.

You do not need to provide a reason for exercising your right of withdrawal.

2. HOW TO EXERCISE YOUR RIGHT

To exercise your right of withdrawal, please contact us clearly stating that you wish to cancel your purchase.

Please include your order number and, where possible, the name of the product you are returning.

You may use the following wording:

I hereby inform you that I wish to withdraw from my contract of sale for the following product(s): [PRODUCT NAME / ORDER NUMBER].
Order date: [DATE]
Received on: [DATE]
Name: [NAME]
Address: [ADDRESS]

You may use this wording or simply send us a clear statement that you wish to withdraw. A specific form is not required.

3. RETURNING THE PRODUCT

After notifying us that you wish to withdraw, you should return the product to us without undue delay and normally within 14 days of notifying us of your withdrawal.

Please contact us before sending the parcel so that we can provide the appropriate return address and instructions.

The product should be packaged securely so that it is not unnecessarily damaged during return transit.

Unless the law requires otherwise, you are responsible for the direct cost of returning the goods.

4. CONDITION OF RETURNED PRODUCTS

You may handle the product to the extent necessary to establish its nature, characteristics and functioning, in the same way that you would reasonably be able to inspect it in a shop.

You may be responsible for any reduction in the value of the product resulting from handling beyond what is necessary to establish its nature, characteristics and functioning.

For this reason, please take reasonable care when inspecting your purchase.

Where possible, please return products in their original packaging and with any accompanying documentation or accessories.

5. REFUNDS

If you validly exercise your right of withdrawal, we will refund the payments received from you, including the applicable standard delivery charge for the original order, subject to applicable law.

If you selected a more expensive delivery option than our standard delivery service, we are not required to reimburse the additional cost where permitted by law.

Refunds will normally be made using the same payment method used for the original transaction, unless otherwise agreed.

We may withhold reimbursement until we have received the returned goods or until you provide evidence that the goods have been sent back, whichever occurs first, as permitted by applicable law.

6. RETURN SHIPPING COSTS

Unless the product is faulty, incorrect or otherwise does not conform to the contract, the customer is normally responsible for the direct cost of returning goods when exercising the right of withdrawal.

If a product is defective, damaged on arrival or incorrectly supplied, please contact us before returning it so that we can arrange the appropriate remedy.

7. EXCEPTIONS TO THE RIGHT OF WITHDRAWAL

The right of withdrawal does not apply in every circumstance.

Depending on the nature of the product, exceptions under applicable consumer law may include certain products:

  • made to the consumer's specifications;

  • clearly personalised;

  • liable to deteriorate or expire rapidly;

  • sealed products that are not suitable for return for health protection or hygiene reasons once unsealed;

  • sealed products that have been unsealed after delivery where the law provides an applicable exception;

  • or other categories specifically excluded by applicable law.

We will identify relevant restrictions on the individual product page where appropriate.

Handmade and botanical products

The fact that a product is handmade, natural or botanical does not automatically remove the statutory right of withdrawal.

Where a specific botanical product falls within a legal exception, this will be stated clearly in its product description.

For example, where a product is supplied sealed and applicable law considers it unsuitable for return after the seal has been broken for health or hygiene reasons, the withdrawal right may no longer apply once the seal has been broken.

8. CUSTOM OR PERSONALISED PRODUCTS

Products made specifically to your measurements, design, specifications or personal requirements may be excluded from the statutory right of withdrawal where permitted by applicable law.

Any such restriction will be communicated before you place your order.

9. FAULTY OR DAMAGED PRODUCTS

The right of withdrawal is separate from your statutory rights concerning products that are faulty, damaged, defective or do not conform to the contract.

If you receive a damaged or defective product, please contact us as soon as possible.

Please provide:

  • your order number;

  • photographs of the product;

  • photographs of the packaging where relevant; and

  • a description of the problem.

We will assess the issue and provide the appropriate remedy in accordance with applicable consumer law.

10. BOTANICAL PRODUCTS

Our dried eucalyptus, laurel and other botanical products are natural materials and may naturally change in colour, texture, shape or scent over time.

Such natural characteristics are not necessarily defects.

However, natural variation does not remove your statutory consumer rights where those rights apply.

Please follow the individual product's care and safety instructions.

11. EXCHANGES

We do not routinely offer direct exchanges.

If you wish to change an item because you have changed your mind, you may exercise your right of withdrawal where applicable and place a new order for the replacement product.

If the product is faulty or incorrect, please contact us and we will arrange an appropriate remedy.

12. LEGAL RIGHTS

Nothing in this policy limits or replaces any mandatory rights you have under Portuguese or European Union consumer law.

Where this policy conflicts with a mandatory consumer protection rule, the applicable legal rule takes precedence.
