Welcome to the Labuta Laureada online shop.

These Terms of Service apply to purchases made through our website and govern the relationship between you and Labuta Laureada in relation to products and services purchased through the site.

By placing an order, you confirm that you have read and understood these terms.

1. ABOUT US

Labuta Laureada is a small, independent project based in Portugal, creating and offering handcrafted products, botanical items, bamboo goods, table decorations, homewares and other products inspired by our land and surroundings.

Our products are made in small quantities and, where stated, individually by hand.

2. OUR PRODUCTS

We make every effort to ensure that product descriptions, photographs, dimensions and prices displayed on our website are accurate.

However, many of our products are made from natural materials such as bamboo, wood, dried flowers and plants.

Natural variations in:

• colour

• texture

• grain

• shape

• markings

• size

are normal and should not be considered defects.

Hand-carved and handmade products may also differ slightly from the photographs shown online. These variations are part of the character of a handmade product.

3. PRODUCT AVAILABILITY

Our products are generally produced in small batches and may be available only in limited quantities.

If a product becomes unavailable after you have placed an order, we will contact you as soon as possible and offer either a suitable alternative or a full refund.

4. PRICES

All prices displayed on the website are in euros (€).

Prices are subject to change without notice, although any change will not affect an order that has already been accepted and confirmed.

Delivery and packaging charges are shown separately where applicable.

5. ORDERS

When you place an order through our website, you are making an offer to purchase the selected products.

Your order is accepted when we confirm the order and payment has been successfully received.

We reserve the right to decline or cancel an order in exceptional circumstances, including obvious pricing errors, stock discrepancies, suspected fraudulent transactions or circumstances beyond our reasonable control.

If we cancel an order after payment has been received, you will receive a full refund.

6. PAYMENT

Payment must be completed through the payment methods offered on our website at the time of purchase.

We do not store your complete payment card details.

Orders will normally only be processed once payment has been successfully authorised.

7. SHIPPING & DELIVERY

We ship from Portugal.

Estimated delivery times are provided as a guide and may vary depending on destination, carrier delays, customs procedures and circumstances outside our control.

We are not responsible for delays caused by postal or courier services, customs authorities, strikes, extreme weather or other events beyond our reasonable control.

You are responsible for providing a complete and accurate delivery address.

If an order is returned to us because an incorrect or incomplete address was provided, additional postage may be required before the order can be sent again.

8. PACKAGING

We take care when packaging every order, particularly fragile handmade and bamboo products.

Where possible, we use recycled, recyclable and paper-based packaging materials.

Packaging costs may be included within the applicable delivery charge.

9. DAMAGED GOODS

If your order arrives damaged, please contact us as soon as reasonably possible.

Please provide:

• your order number

• photographs of the damaged product

• photographs of the packaging

• a brief description of the damage

We will assess the situation and work with you to provide an appropriate remedy in accordance with applicable consumer law.

Please retain the original packaging until the matter has been resolved.

10. RETURNS AND CANCELLATIONS

For consumer purchases within the European Union, you may have a statutory right to cancel your purchase within 14 days of receiving the goods, subject to applicable legal exceptions.

Where the right of withdrawal applies, the product should be returned within the applicable period and in accordance with the requirements of Portuguese and EU consumer law.

Products should be returned in an appropriate condition, allowing for reasonable inspection of the goods.

Certain products may be excluded from the statutory right of withdrawal where permitted by law, including products that have been made to your specifications or clearly personalised for you.

Nothing in these Terms limits any mandatory consumer rights that apply to you under Portuguese or EU law.

11. REFUNDS

Where a refund is due, we will process it using the original payment method unless otherwise agreed or required by law.

Where applicable, the refund will include the standard delivery cost paid for the original order, subject to the requirements of applicable consumer law.

Additional costs resulting from a customer's choice of a more expensive delivery option may not be refundable where permitted by law.

12. HANDMADE AND NATURAL MATERIALS

Our products are not mass-produced.

Small imperfections, variations and differences between individual pieces are expected.

For example, bamboo may contain natural markings, changes in colour, variations in diameter and differences in texture.

Dried botanical products may also naturally change over time.

These characteristics are part of the nature of the materials and do not necessarily indicate a fault.

13. CARE OF PRODUCTS

Customers are responsible for following any care instructions supplied with the product.

Natural bamboo, dried flowers and botanical products should generally be kept away from excessive moisture, prolonged direct sunlight, extreme temperatures and sources of heat unless the product description specifically states otherwise.

We cannot accept responsibility for damage caused by improper use, neglect or failure to follow care instructions.

14. BAMBOO AND BOTANICAL PRODUCTS

Some products contain natural materials and may be intended primarily for decorative use.

Unless a product is specifically described as food-safe, it should not be assumed to be suitable for direct contact with food.

Products intended for decorative purposes should not be used for purposes other than those described in their product listing.

15. INTELLECTUAL PROPERTY

All photographs, product descriptions, branding, logos, artwork, written content and other material appearing on the Labuta Laureada website are owned by or licensed to Labuta Laureada unless otherwise stated.

You may not reproduce, copy, modify, distribute or commercially use our content without our prior written permission.

16. WEBSITE CONTENT

We make reasonable efforts to ensure that the information on our website is accurate and up to date.

However, occasional errors, omissions or technical issues may occur.

We reserve the right to correct errors, update information and make changes to products, descriptions and availability where necessary.

17. THIRD-PARTY SERVICES

Our website may use third-party services for payment processing, website hosting, analytics, delivery and other functions.

Those services may have their own terms and privacy policies.

We are not responsible for the independent operation of third-party services, although we will take reasonable steps to work with service providers where an issue affects your order.

We will not be responsible for failure or delay in performing our obligations where this results from circumstances beyond our reasonable control.

This may include natural disasters, extreme weather, fire, flood, interruption of transport, strikes, infrastructure failure, government restrictions or other events outside our reasonable control.

19. LIABILITY

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.

We are not responsible for losses resulting from misuse of our products, failure to follow product instructions or use of a product for a purpose for which it was not designed.

Your statutory consumer rights remain unaffected.

20. PRIVACY

Any personal information provided when placing an order will be handled in accordance with our Privacy Policy.

We only collect and use personal information as reasonably necessary to process orders, provide services, communicate with customers and meet our legal obligations.

21. GOVERNING LAW

These Terms are governed by the laws applicable in Portugal, without prejudice to any mandatory consumer protections that apply to customers in their country of residence under applicable European Union law.

Where a consumer dispute cannot be resolved directly, customers may have access to applicable alternative dispute resolution mechanisms and other consumer protection rights available under Portuguese and EU law.

The version applicable to your purchase will be the version in force at the time your order is placed.
